Welcome to Fast Industries.
The terms “we”, “us” and “our” refer to Fast Industries. Fast Industries operates this website and online store, including the information, content, features, tools, products and services made available through it (the “Services”).
Our online store is powered by Shopify, which provides the ecommerce platform that enables us to offer products and services to you.
These Terms of Service (“Terms”), together with any policies referenced in them, describe the terms that apply when you access or use our Services or purchase products from Fast Industries.
Please read these Terms carefully.
By accessing, interacting with or using our Services, or placing an order with Fast Industries, you agree to these Terms and our applicable policies.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.
SECTION 1 – ACCESS AND ACCOUNTS
By using the Services, you represent that you are legally capable of entering into a binding agreement or have the appropriate permission or supervision required under applicable law.
When using the Services or placing an order, you may be required to provide information including your name, email address, billing information, payment information, shipping address and telephone number.
You agree to provide information that is current, complete and accurate.
If you create an account, you are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account.
SECTION 2 – PRODUCTS & PRODUCT INFORMATION
Fast Industries makes reasonable efforts to ensure product descriptions, specifications, photographs, pricing, compatibility information and other product information are accurate.
Actual product appearance may vary slightly from photographs because of manufacturing variations, materials, production methods, lighting, displays or device settings.
Automotive products may also vary according to vehicle model, production date, specification, modification history or other factors.
Customers are responsible for reviewing the product description and stated fitment information before purchasing.
If you are unsure whether a product is suitable for your vehicle or application, please contact Fast Industries before ordering.
We may modify or discontinue products and may limit product quantities or availability at any time.
Nothing in this section excludes any applicable consumer guarantee relating to product description, quality, fitness for purpose or other rights that cannot lawfully be excluded.
SECTION 3 – ORDERS
When you submit an order, you are making an offer to purchase the selected products or services.
Fast Industries may accept or decline an order, subject to applicable law.
An order may be declined or cancelled where, for example:
- A product is unavailable.
- An obvious pricing or listing error has occurred.
- Payment cannot be authorised or verified.
- Fraud or unauthorised activity is reasonably suspected.
- Shipping to the requested destination is unavailable or impractical.
- An order cannot lawfully be supplied.
If Fast Industries cancels an order after payment has been received, amounts paid for products or services that will not be supplied will be refunded as appropriate.
Customers should review their order carefully before submitting it.
Cancellation and return requests are handled in accordance with our Returns & Refunds Policy and applicable consumer law.
SECTION 4 – PRICES, PAYMENT & BILLING
Prices, discounts and promotions may change without notice.
The price charged will generally be the price displayed and accepted at the time the order is placed, subject to correction of obvious errors and applicable law.
Unless otherwise stated, Australian prices displayed to Australian customers include applicable Australian GST.
Shipping and handling charges are displayed separately where applicable.
International orders may be displayed or charged in another currency depending on the customer's location and available checkout options.
International orders may also be subject to destination-country duties, taxes, customs charges, brokerage fees or similar charges as described in our Shipping Policy.
Customers agree to provide current, complete and accurate billing, payment and contact information.
SECTION 5 – SHIPPING & DELIVERY
Orders are processed and dispatched in accordance with our Shipping Policy.
Available shipping services, rates and estimated delivery times may vary depending on destination, order size, weight and selected carrier service.
Carrier delivery estimates are estimates only and may be affected by carrier delays, customs processing, weather, remote-area delivery and circumstances outside the reasonable control of Fast Industries.
Where Same Day Rush is offered and purchased, the applicable dispatch commitment is governed by our Shipping Policy.
If an order is delayed, lost or damaged during transit, customers should contact Fast Industries so that we can provide reasonable assistance and, where applicable, investigate the matter with the carrier.
Nothing in this section excludes, restricts or modifies any rights or remedies available under applicable consumer law.
SECTION 6 – AUTOMOTIVE, PERFORMANCE & AFTERMARKET PRODUCTS
Fast Industries sells automotive, aftermarket and performance products.
Some products may be intended for modified, competition, racing, off-road or other specialised applications and may not be suitable or lawful for use on public roads in every jurisdiction.
Customers are responsible for determining whether a product is suitable and lawful for their intended application and for complying with applicable vehicle, roadworthiness, registration, emissions, insurance and other legal requirements.
Installation of aftermarket or performance products may alter vehicle operation and may place additional loads or stresses on existing vehicle components.
Products should be installed correctly and in accordance with applicable instructions, specifications and accepted automotive practices.
Fast Industries is not responsible for damage caused by incorrect installation, misuse, unauthorised modification, neglect or use outside a product's intended application to the extent permitted by law.
Products that have been installed, attempted to be installed, modified or used are generally not eligible for change-of-mind returns.
Nothing in this section excludes, restricts or modifies any applicable consumer guarantee or other right that cannot lawfully be excluded.
SECTION 7 – FITMENT & VEHICLE COMPATIBILITY
Vehicle fitment information is provided to assist customers in selecting suitable products.
Compatibility may depend on vehicle model, variant, production date, engine, transmission, factory options, previous modifications and other factors.
Customers should confirm applicable product specifications and fitment information before installation.
Where a customer specifically communicates an intended purpose or vehicle application to Fast Industries and relies on our advice, any applicable rights under consumer law remain unaffected.
SECTION 8 – CUSTOM, MADE-TO-ORDER & MANUFACTURED PRODUCTS
Some Fast Industries products may be manufactured, modified, configured or ordered specifically for a customer.
Once production, modification or special ordering has commenced, cancellation or change-of-mind returns may not be available for these products.
This does not exclude any applicable rights where a product is faulty, incorrectly supplied, does not match its description or otherwise fails to meet an applicable consumer guarantee.
SECTION 9 – INTERNATIONAL ORDERS
Fast Industries ships to selected international destinations made available at checkout.
Customers placing international orders are responsible for checking whether the products may lawfully be imported, installed and used in their destination country.
International orders may be subject to duties, taxes, customs charges, brokerage fees or other destination-country charges.
Unless those charges are expressly collected by Fast Industries at checkout, they are the responsibility of the recipient.
International shipping, customs clearance, refused shipments and returned international parcels are further governed by our Shipping Policy.
Nothing in this section excludes any rights that apply to an international customer and cannot lawfully be excluded.
SECTION 10 – RETURNS, REFUNDS & WARRANTIES
Returns, refunds, exchanges and change-of-mind requests are governed by our Returns & Refunds Policy.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law where that law applies.
Some products may also include manufacturer or supplier warranties. Those warranties operate in addition to any statutory rights and do not replace or limit rights that cannot lawfully be excluded.
SECTION 11 – INTELLECTUAL PROPERTY
Unless otherwise stated, content made available through the Fast Industries Services, including trademarks, logos, branding, product names, text, graphics, photographs, videos, technical drawings, designs and other original content, is owned by or licensed to Fast Industries.
You may access and use this content for ordinary personal and purchasing purposes.
You must not reproduce, commercially exploit, distribute, modify or otherwise use Fast Industries intellectual property without permission where such permission is required by law.
Third-party trademarks and intellectual property remain the property of their respective owners.
SECTION 12 – OPTIONAL TOOLS & THIRD-PARTY SERVICES
The Services may provide access to tools, payment services, shipping services or other functionality supplied by third parties.
Use of third-party services may also be subject to the relevant provider's terms and policies.
Fast Industries does not control every aspect of third-party services and is not responsible for matters outside our reasonable control, subject to applicable law.
SECTION 13 – THIRD-PARTY LINKS
The Services may contain links to third-party websites or services.
Fast Industries does not control third-party websites and is not responsible for their content, security, availability or practices.
Customers should review applicable terms and policies before entering into transactions with third parties.
SECTION 14 – RELATIONSHIP WITH SHOPIFY
The Fast Industries online store is powered by Shopify.
Shopify provides the ecommerce platform used to deliver portions of the Services.
Purchases made from Fast Industries are transactions between the customer and Fast Industries unless expressly stated otherwise.
SECTION 15 – PRIVACY
Personal information collected through the Services is handled in accordance with our Privacy Policy and applicable privacy laws.
Third-party providers used to operate our store may also process information in accordance with their respective privacy policies.
SECTION 16 – REVIEWS, FEEDBACK & USER CONTENT
If you voluntarily provide Fast Industries with a review, photograph, feedback, suggestion or other content, you confirm that you have the right to provide that content.
Where you provide content for publication or promotional use, you grant Fast Industries a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content for legitimate business, marketing and promotional purposes, subject to applicable law.
Fast Industries will not knowingly use customer-provided content in an unlawful or misleading manner.
SECTION 17 – ERRORS, INACCURACIES & OMISSIONS
Occasionally information on the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, availability, shipping or other information.
Fast Industries may correct errors or update information where reasonably necessary.
Where an error affects an existing order, Fast Industries will handle the matter reasonably and in accordance with applicable law.
SECTION 18 – PROHIBITED USES
You may use the Services only for lawful purposes.
You must not use the Services to:
- Violate applicable laws or regulations.
- Infringe intellectual property rights.
- Transmit malicious software or code.
- Attempt unauthorised access to systems or accounts.
- Collect personal information unlawfully.
- Engage in fraudulent or deceptive activity.
- Interfere with or disrupt operation of the Services.
- Harass, abuse or unlawfully discriminate against another person.
Fast Industries may restrict or terminate access to the Services where reasonably necessary to protect the business, customers, systems or other users.
SECTION 19 – AVAILABILITY OF SERVICES
Fast Industries does not guarantee that the website or Services will always be uninterrupted, secure or error-free.
We may temporarily suspend, modify or discontinue parts of the Services for maintenance, security, operational or other legitimate business reasons.
SECTION 20 – LIMITATION OF LIABILITY
To the extent permitted by law, Fast Industries is not liable for indirect or consequential loss arising from use of the Services or products where such loss was not reasonably foreseeable or was caused by circumstances outside our reasonable control.
Nothing in these Terms excludes, restricts or modifies liability, consumer guarantees, rights or remedies that cannot lawfully be excluded or limited under the Australian Consumer Law or other applicable law.
Where liability may lawfully be limited, it will be limited only to the extent permitted by applicable law.
SECTION 21 – INDEMNIFICATION
To the extent permitted by law, you agree to indemnify Fast Industries against reasonable losses, liabilities or expenses arising directly from your unlawful use of the Services, infringement of third-party rights or material breach of these Terms.
This section does not require a customer to indemnify Fast Industries for loss caused by Fast Industries' own unlawful conduct, negligence or breach of applicable consumer obligations.
SECTION 22 – TERMINATION & SUSPENSION
Fast Industries may suspend or terminate access to the Services where reasonably necessary because of unlawful activity, fraud, security concerns, misuse of the Services or material breach of these Terms.
Termination does not affect rights, obligations or amounts that accrued before termination.
SECTION 23 – SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be treated as modified or severed to the minimum extent necessary.
The remaining provisions will continue to operate to the extent permitted by law.
SECTION 24 – WAIVER & ENTIRE AGREEMENT
A failure by Fast Industries to immediately enforce a provision of these Terms does not constitute a waiver of that provision.
These Terms, together with our Privacy Policy, Shipping Policy, Returns & Refunds Policy and other applicable policies, form the terms governing use of the Services and purchases from Fast Industries.
SECTION 25 – GOVERNING LAW
These Terms are governed by the laws of Queensland, Australia.
The parties submit to the jurisdiction of the courts of Queensland and any courts having jurisdiction to hear appeals from those courts.
Nothing in this section limits any mandatory rights or jurisdiction available to a consumer under applicable law.
SECTION 26 – CHANGES TO THESE TERMS
Fast Industries may update these Terms from time to time to reflect changes to our business, Services, policies or legal requirements.
The current version and its effective date will be published on the Fast Industries website.
Changes will not retrospectively remove rights that have already accrued under an existing purchase or applicable law.
